The Boston Business Journal quotes David Rubin in “Follower Fight”

David Rubin, a partner in the Litigation Department and a member of the firm’s Labor, Employment and Benefits practice group, was quoted by the Boston Business Journal in “Follower Fight” on November 16. The article discusses the thorny question of who owns employees’ followers on social media networks, such as Twitter and LinkedIn, after the employee leaves the company. The question has become a hot button issue at many companies and both parties are increasingly turning to the courts to decide ownership. “The trickier cases will be the ones where companies have not set up policies stating that the person who is tweeting or otherwise building a social network for a company does not have rights to that account after that person leaves,” said David. “A lot of this comes up not because companies said, ‘go out and do this,’ but because they had a worker who had the foresight to just start doing it,” David notes. “And then it became part of the institution...Those will be the toughest cases.”
